1. SCOPE AND VALIDITY OF THE TERMS
1.1. The terms and conditions apply to the legal relations between all persons and the owner of the shopping environment doglo.eu (hereinafter Doglo e-shop) Traxby OÜ regarding the purchase of products via the Doglo e-shop.
1.2. In addition to these terms and conditions, the legal relations arising from the purchase of products through the Doglo e-shop are regulated by the legislation in force in the Republic of Estonia.
1.3. Traxby OÜ has the right to withdraw from the sales contract entered into via the e-shop and not to deliver the ordered goods or provide the service in the following cases:
- the goods have run out of stock;
- the price or features of the goods have been displayed incorrectly in the e-shop due to a system error.
If it is not possible for Traxby OÜ to fulfil the order, the buyer will be contacted by e-mail or telephone and the amount of the order will be refunded if the buyer has managed to make an advance payment for the goods.
1.4. Traxby OÜ is entitled to amend and supplement these terms and conditions and the price list due to the development of the Doglo e-shop and in the interests of better and safer use of the e-shop. Amendments and supplements to the Terms and Conditions and the Price List will be announced via the website www.doglo.com. Amendments and supplements to the Terms and Conditions and the Price List shall enter into force upon publication of the respective amendment or supplement on the website doglo.eu. If you forwarded your order before the changes to the terms and conditions came into force, the legal relationship between you and Traxby OÜ will be governed by the terms and conditions in force at the time of submitting the order, unless otherwise provided by law or these terms and conditions.
2. PRICES
2.1. The prices of the Doglo e-shop are valid for the timely payment of the invoice as provided in clause 4.
2.2. All prices include 20% VAT and are presented in Euros.
3. SHOPPING CART AND PLACING AN ORDER
3.1. Add the ordered products or services to the shopping cart. Choose whether you are already a user of the Doglo e-shop environment, want to create a new account or buy as a guest. If necessary, enter your personal data and address, or check previously entered data. Be careful when adding the customer data, because fast and trouble-free delivery of the products you have purchased depends on the accuracy and correctness of such information.
3.2. Choose the appropriate delivery method. Depending on the delivery method chosen, the shopping cart may ask for additional information to specify the delivery destination of the product.
3.3. After selecting a delivery method, a selection of payment methods will appear. Choose the payment method that suits you.
3.4. The contract for the sale of products is considered concluded (entry into force of the contract) as of the receipt of the amount payable according to the order confirmation to the current account of Traxby OÜ, Maksekeskus AS or Montonio Finance, which mediates the payment service.
4. PAYMENT FOR PRODUCTS
4.1. To make a payment, select a suitable payment method on the ordering page.
4.2. You can pay for the products:
- via a bank link through Maksekeskus AS or Montonio Finance;
- by bank transfer in euros.
4.3 Your order will be cancelled if you have not paid the purchase amount within 5 days.
5. DELIVERY AND TRANSFER OF PRODUCTS
5.1. The delivery partners of the Doglo e-shop are Omniva (Eesti Post AS) and SmartPost (Itella Estonia OÜ), which deliver products in 1-3 working days on average (using parcel machines and courier services). Products can be ordered worldwide in all countries, which are available at checkout. The maximum delivery time is 10 working days, which may depend, among other things, on the stock of the Doglo e-shop.
5.2. After the entry into force of the Agreement in accordance with clause 3.4 of the Conditions the products will be delivered you at the place you notified when placing the order at a pre-agreed time. Check the delivery terms.
5.3. Please check the correctness of the contact information provided when placing order to avoid delays and misunderstandings in the delivery of products. Traxby OÜ is not responsible for delays in the delivery of products and misunderstandings if the delay or misunderstanding is due to the incorrectness or inaccuracy of the information you provided when placing the order.
6. CANCELLING ORDERS AND RETURNING PRODUCTS
6.1. You have the right to cancel your order after paying for the products, but before delivery of the products, by sending a corresponding notice to the e-mail address of the Doglo e-shop info@doglo.eu indicating with the order number and your current account number.
6.2. After receiving the products, you have 14 days to return the product (s). If for some reason the purchased goods are not suitable for you, you may return the product or exchange it for another product within 14 days by sending a corresponding cancellation notice with the order number to the Doglo e-shop e-mail address info@doglo.eu. Software licenses are not refundable.
6.3. The returned product must be complete (including all items which the product package contained – cables, etc.) and you have familiarized yourself with the nature, characteristics and operation of the product as you would normally be allowed to do in a store. If the product has been purchased as part of a campaign where another product has been added to the product, you must return the entire set (i.e. all products).
6.4. If the order is cancelled in the case provided in clause 6.1 or withdrawn from the order in the case provided in clause 6.2, the amount paid for the purchase will be refunded, from which the customer will bear the costs related to sending the product to the warehouse up to 10 EUR (clause 6.5). We will refund the returned product to your current account no later than within 14 days from the receipt of the notice of withdrawal, provided that you have returned the goods within the same term, except in the cases provided in clauses 6.4, 6.5 and 6.6 of these terms.
6.5. The Doglo e-shop has the right to ask the customer for the transport cost of the returned product in the amount of up to 10 EUR and to deduct the amount from the amount refundable.
6.6. If the returned product (and the product packaging) has deteriorated and the deterioration is caused by circumstances that are not caused by Traxby OÜ; and as a result of misuse of the product, Traxby OÜ has the right to set off the decrease in the value of the product with the amount paid by you for the product and to be returned to you. For set-off, Traxby OÜ will send you a set-off application to the e-mail address you provided when placing the order. If you do not agree with the decrease in value indicated in the set-off notice, you have the right to involve an independent expert to determine the decrease in value of the product. The costs related to the expertise shall be divided in half between you and Traxby OÜ unless the position of one of the parties is obviously unfounded. In such a case, the costs of the expert examination shall be borne by the party whose position was manifestly unfounded.
7. WARRANTY AND RETURN OF NON-COMPLIANT PRODUCTS
7.1. Traxby OÜ is responsible for non-compliance of the products with the requirements and defects that appear within 2 years from the delivery of the products to you.
7.2. Traxby OÜ is not responsible for:
- your fault for product deterioration / damage;
- defects caused by irregular use of the product;
- for normal physical wear and tear of the product during normal use (e.g. batteries, chargers, etc.).
7.3. In case of non-conformity or defect of the product, you have the right to demand the replacement of the product with a compliant and defect-free product or to withdraw from the order and return the non-compliant product at the expense of Traxby OÜ.
7.4. In case of returning a non-compliant product, the amount paid for the product (including transport costs) will be transferred to the bank account indicated by you no later than within 30 days from the receipt of the notice of withdrawal and request to return the product.
7.5. In addition to the rights arising from the guarantee, you also have other rights arising from law.
8. LIABILITY AND FORCE MAJEURE
8.1. Traxby OÜ is liable to you and you are liable to Traxby OÜ for the damage caused to the other party by the violation of these terms and conditions in the cases and to the extent provided by the legislation in force in the Republic of Estonia.
8.2. Traxby OÜ is not liable for damages caused to you or for delay in delivery of the product if the damage or delay in delivery of the product is due to a circumstance which Traxby OÜ could not influence and the arrival of which Traxby OÜ did not or could not have foreseen (force majeure).
9. OTHER CONDITIONS
9.1. All personal data of the customer that has become known during the visit to the Doglo e-shop and during the performance of purchases will be treated as confidential information. An encrypted data communication channel with banks ensures the security of the purchaser’s personal data and bank details. Traxby OÜ has no have access to them.
9.2. In matters not resolved separately in these terms and conditions, the legislation in force in the Republic of Estonia shall be followed.
9.3. Disputes between you and Traxby OÜ in regard with ordering and purchasing products via the Doglo e-shop shall be resolved through negotiations. If no agreement is reached, you have the right to turn to the Consumer Protection Board to protect your rights. Disputes shall be resolved in accordance with the legislation in force in the Republic of Estonia.
9.4. The products sold in the Traxby OÜ e-shop are not intended for resale by legal entities. Any relevant orders will be cancelled.
9.5. Products resold by legal entities are not covered by Doglo warranty.
